DIRECTV^® Programming Agreement: Within 30 days of purchase of your DIRECTV System equipment, you agree to activate: any DIRECTV ® TOTAL CHOICE ® programming package (valued at $41.99 per mo. or above); or, any DIRECTV PARA TODOS ® programming package (valued at $29.99 per mo. or above); or, any qualifying international services bundle, which bundle shall include either the DIRECTV ® BASIC programming package (valued at $9.99 per mo.) or the DIRECTV ® PREFERRED CHOICE ™ programming package (valued at $29.99 per mo.) together with any WorldDirect ™ international-language service. DVR service activation ($5.99/mo.) required for DVR and HD DVR system purchases. In certain markets, programming and pricing may vary. DIRECTV PROGRAMMING AND PRICING SUBJECT TO CHANGE AT ANY TIME. The programming package(s) must be maintained for a period of twelve (12) consecutive months (without interruption) for standard receiver(s), and twenty-four (24) consecutive months (without interruption) for advanced product receiver(s) (DVR[s], HD Receiver[s] and/or HD DVR[s]) purchased by you, including additional DIRECTV Receivers ($4.99 per month for separate programming on 2nd and each additional TV as long as all receivers are connected to the same phone line). After you have fulfilled your agreement to the required programming package(s), you are not obligated to continue your subscription to DIRECTV programming for any specific duration. Current DIRECTV customers may activate additional receivers with their existing DIRECTV programming package.

Consequences of Your Failure to Maintain Agreement: If you fail to maintain your programming commitment, you agree that DIRECTV may charge you a prorated fee of up to one hundred fifty U.S. dollars ($150) for standard receivers and up to three hundred U.S. dollars ($300) for advanced receivers. Within 14 days of downgrading or disconnecting your programming, you have an option to send all of your DIRECTV System equipment (receiver[s] and remote control[s]) to DIRECTV in lieu of this payment. The equipment, including the Access Card inserted into each DIRECTV System Receiver unit, must be returned to DIRECTV in good working order, normal wear and tear excepted.

THIS PROGRAMMING AGREEMENT IS SEPARATE AND DIFFERENT FROM ANY OTHER PROGRAMMING COMMITMENT AGREEMENT YOU MAY HAVE PREVIOUSLY MADE WITH DIRECTV AND IS FULLY ENFORCEABLE UNDER THESE TERMS.

DIRECTV Customer Agreement: You hereby agree and acknowledge that this DIRECTV Programming Commitment Agreement sets forth additional terms and conditions regarding your receipt of DIRECTV programming and activation of access cards and shall be applied in conjunction with the DIRECTV Customer Agreement, a copy of which is provided at DIRECTV.com and with your first bill.

Arbitration: You and DIRECTV agree that both parties will resolve any dispute arising under this Agreement, the DIRECTV Customer Agreement or any addendum thereto, or your DIRECTV service, through binding arbitration as fully set forth in the DIRECTV Customer Agreement. Arbitration means you waive your right to a jury trial.
